A lot of people seem to have a problem with the presumption of innocence for George Zimmerman, but not Trayvon Martin. They have certainly shown a bias that would prevent them from serving on a jury in this case, if it goes to trial.
I wonder if this is what "better that ten guilty persons escape than that one innocent suffer" (Blackstone) or "it is better one hundred guilty persons should escape than that one innocent person should suffer" (Franklin) looks like when applied to self-defense?
Some seem to prefer Bismarck's "it is better that ten innocent men suffer than one guilty man escape"? The discussion we have been having shows what happens when you filter which way to go through a racial bias?
Martin may have been standing his ground and defending himself from a racist Zimmerman and lost. Had he won it would have been a shame he got screwed by the system because he didn't retreat.
I believe the rationale in removing the obligation to retreat is that retreat can't always be done safely and doing so when it isn't safe may put you at more risk, give the advantage to the attacker. Retreating when it's safe is my first choice, but I like not being obligated to retreat when it isn't safe.
Throwing all obvious self defense cases without a retreat into court for a jury to sort out left too many innocent people with huge legal expenses. Now FL has gone too far the other way?
New Mexico has never had an obligation to retreat, and we don't have the problems FL is having. Looking at the FL statute I see numerous exceptions to the stand your ground defense that might have applied in the Zimmerman/Martin case. At least one investigator thought so too, but he was overruled by a state attorney who disagreed, thought the case was too weak. The law isn't the problem, it's the people applying the law.
I think this should have been on it's way to court a month ago. Until then I will presume Zimmerman is innocent until proven guilty and refrain from doing to him what he may have done to Martin.
